Privacy Policy

The following Privacy Policy is effective from July 8, 2021. This Privacy Policy may be updated from time to time. Any changes made will be posted on this page. Users are advised to consult the Privacy Policy regularly for any updates and changes.

Deadstock, LLC, a California limited liability company (“we”, “us”, “our”) is committed to protecting and respecting your privacy. We provide this Privacy Policy to inform the user (“you”) about our collection, use, and disclosure of information when you visit http://deadstock.co (our “Site”)  and our mobile application ( our “App”) and any other digital products and services that we provide (collectively referred to as our “Services”). By using our Services, you acknowledge you have read and understood this Privacy Policy. Deadstock will not sell your information to third parties.

Information Collection

Personal Information. Throughout your use of our Services, we may ask you for certain “Personal Information” that can be used to identify and/or contact you, including but not limited to: your name, email address, phone number, and preferred payment method such as your credit card information and other billing information. If you provide us details of your payment method, or make a purchase or sale through our Services, we will not store or collect your payment method details. Such information is provided directly to our third-party payment processors whose use of your personal information is governed by their own privacy policy(ies). Personal Information also includes information referred to as “personally identifiable information” or “personal information” under applicable data privacy laws, rules, or regulations. This policy does not cover the practices of companies, third parties, or individuals we don’t own, control, or manage. 

We collect Personal Information in relation to your registration with and use of our Services. It also includes information you provide when you search for a product, create a product listing, upload photos, place an order on or via our Services, enter a competition, promotion or survey, submit a query, product likes or shares, and when you report a problem with our Services.  

Personal Information of Minors and Children. Our services are not intended for use by individuals under the minimum age of 18, as detailed in our Terms and Conditions. By agreeing to our Terms and Conditions and using our Services, you agree that you are at least 18 years of age. If we learn that we have collected personal information from any individual under the age of 18, we will immediately delete that information from our database. If a parent or guardian becomes aware that their child under the age of 18 has provided Personal Information, please contact our Help page. 

SNS-linked Accounts. During the registration process, or when listing an item for sale through our Service, you may also have the option to link certain information on your Deadstock account with certain third-party social networking sites (“SNS”), including but not limited to, Instagram, Facebook, and Twitter. If you select the option to link your Deadstock account with your SNS account, we will obtain certain information you have provided to the SNS (such as your name or username, profile picture, email address, and other information made publicly available via the applicable SNS) from the account you have with such SNS and import that information to your Deadstock account (“Account”). The information we obtain may depend on the privacy settings you have set with the applicable SNS. The information an SNS has about you is obtained by the SNS independent of our Services, as we do not have control over their privacy policy(ies). 

Technical Information/Information about your Visit. We will automatically collect information from you each time you visit and use our Services, whether as a registered user of Deadstock or as a non-registered user, including but not limited to: technical information from your browser and device, and information about your visit. Such technical information may include the Internet protocol (IP) address used to connect your computer to the Internet, browser type and version, your login information, time zone setting, operating system and platform, and browser plug-in types and versions. Such information about your visit may include the full Uniform Resource Locators (URL), clickstream to, through, and from our site (including date and time), products you viewed or searched for, page response times, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), download errors, methods used to browse away from the page, as well as any of your contact information used to contact our Customer Service Department. Our App may also collect information about the precise location of your mobile device when using our Services if such location services are enabled and permission is granted. We may also use your IP address to derive your device’s general location.

Cookies and Other Technologies. We use cookies and similar technologies to collect and store certain information, which typically involve pieces of information or code that a website transfers to or accesses from your computer hard drive or mobile device to store and sometimes track information about you. Cookies and such technologies enable you to be remembered when using that computer or device to interact with websites and online services. They can be used to manage a range of features and content, such as storing your searches, presenting personalized content according to your searches, and distinguishing you from other users of our Services. This enables us to optimize your experience when using our Services, while allowing us to improve our Services. Most web browsers automatically accept cookies and similar technologies. If you prefer, you may change your browser and select the option that prevents the automatic acceptance of cookies and similar technologies. Please note, this may affect your ability to take full advantage of our Services and it may disable certain functions and features of our Services if you do so.

Your browser may support a “Do Not Track” option that can be selected in your browser settings, which sends a signal to websites you visit informing them that you do not want certain information about your visit to be collected. At this time we do not respond to browser “Do Not Track” signals.

Information Use

We may use the information we collect for the following purposes:

  • To provide our Services, complete your transactions, and respond to your inquiries
  • To operate, monitor, improve, maintain, customize, and analyze use of our Services
  • To maintain the security and integrity of our Services
  • To comply with law enforcement when deemed necessary
  • To contact you with Deadstock newsletters, email and other updates, marketing and/or promotional materials, and other information that may be relevant or of interest to you
  • As otherwise disclosed at the time of collection or use.

We may also combine the information we receive from you with information (including Personal Information), as well as combine your information with other Deadstock users’ information to provide you with a better experience, improve the quality and value of our Services, and analyze and understand how our Services are used.

If at any time you no longer wish to receive marketing communications from us, you may select  “Unsubscribe” at the bottom of any marketing email you receive from us to no longer receive them moving forward.

Information Sharing

We may share information collected from you with third parties when deemed necessary and as described in this section. 

Profile Information. When registering or creating a user profile with our Services, any information you choose to share on your profile will be visible to other registered users of our Services. As such, please use your discretion when selecting what information you provide on your user profile.

With Consent. With your consent, or as otherwise disclosed at the time of data collection or sharing, we may share your information.

Service Providers. We may employ third-party companies and individuals to perform Service-related functions, including but not limited to: payment processing, service maintenance, database management, security and fraud detection, marketing, web or advertising analytics, improvement of our Services’ functions and features, as well as to assist us in analyzing how our Services are used.

Affiliates. We may share information with our third-party affiliates, including our subsidiaries who support our processing of Personal Information in order to provide our Services to you under this policy, who will handle the information with regard to their own respective privacy policies. If any of these parties should be using your information for direct marketing purposes, we will only transfer the information to them with your prior consent. Where required by law, we will notify you about your choice about this sharing of your information.

Aggregated and Unidentifiable Information. We may share aggregated or de-identified information that has been made unidentifiable without limitation. This includes but is not limited to the sharing of types of collected technical information as described above to the extent permitted by the law.

Compliance with Laws and Law Enforcement. Whenever necessary, we will cooperate with government and law enforcement officials, as well as private parties, to enforce and comply with applicable laws and regulations. We will disclose any information requested by government or law enforcement officials or by private parties as we, in our sole discretion, deem necessary in response to claims and legal process in order to protect the property, safety, and rights of Deadstock, a third party, the public, or any individual, as well as to prevent or stop any activity we consider to be, or may be, illegal, unethical, or harmful activity.

Business Transfers. We may, at our sole discretion, sell, transfer or otherwise share some or all of our assets, which may include your information, in relation to a potential or actual merger, acquisition, reorganization, or sale of some or all of our assets or in the event of bankruptcy.

Payment Information

Any payments made via our Services are made through our payment processing provider, Stripe. Any payment information, such as credit or debit card information, will be submitted directly to Stripe which operates a secure server to process payment details that encrypts your credit/debit card information and authorizes payment. All card numbers for payment transactions via Stripe are encrypted at rest with AES-256. Please note any information which you provide to Stripe is subject to Stripe’s own privacy policy and terms and conditions and is not within our control. 

Security of your Information

Deadstock uses appropriate security measures to protect against the loss, misuse or alteration of your Personal Information. Although we will do our best to protect your Personal Information, we cannot guarantee the security of your data transmitted to our Services; any transmission is at your own risk as the transmission of information via the internet is not completely secure. To make sure your Internet browser is using the latest security features, we recommend that you download the most recent version of it. All information you provide to us is stored on our secure servers. All card numbers for payment transactions via Stripe are encrypted at rest with AES-256. Where you have chosen a password that enables access to certain parts of our Services, you are solely responsible for remembering and keeping this password confidential. 

External Sites. Our Services may occasionally contain links which may direct you to external websites and applications (“sites”). We do not exercise control over such sites and our providing a link to them should not be seen as an endorsement, authorization, or representation of our affiliation with that third party. Likewise, we are not responsible for the privacy policies or the content of such sites. Please note these other sites follow different rules regarding the use or disclosure of the information you submit to them. We recommend you carefully read the privacy policies of these other sites you visit.

Our Services may also occasionally include integrated social media tools or “plug-ins”, for example, social networking tools offered by third parties. If you share Personal Information when using such tools or if you otherwise interact with these features when using our Services, those third-party companies may collect information about you which they may use and share in accordance with your account settings. These third-party companies and your use of their features are governed by their respective privacy policies and not ours. We recommend you carefully read the privacy policies of any third-party websites and apps that you create an account with or of which you use the features and tools.

Your Choices About Our Collection, Use, and Disclosure of Your Information

We strive to provide you with choices regarding the Personal Information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of over your information. 

Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. You can choose whether or not to allow the Services to collect information through other tracking technologies by changing your cookie settings. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Services may then be inaccessible or not function properly.

Location Information. You can choose whether or not to allow the Services to collect and use real-time information about your device’s location through the device’s privacy setting. If you block the use of location information, some parts of the Services may then be inaccessible or not function properly

Promotion by the Company. If you do not want us to use your email address to promote our products or services, you can opt-out by selecting “Unsubscribe” at the bottom of any marketing email you receive from us to no longer receive them moving forward.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

How Long We Keep Your Information

For as long as you have an account with us, we will retain your personal information in order to meet our contractual obligations to you. Where permitted by law, we may keep your information for six years after termination of your account in order to identify any issues and/or to resolve any legal proceedings. We may also retain aggregate information beyond this time for research purposes and to help us improve our Services, from which you cannot be identified. Local jurisdiction legal retention obligations remain unaffected.

Accessing and Correcting Your Personal Information

You have the right under certain circumstances:

  • to be provided with a copy of your personal information held by us 
  • to request the amending or deletion of your personal information held by us
  • to request that we restrict the processing of your personal information 
  • to object to the further processing of your personal information, such as your right to object to marketing communications
  • to request a copy of your personal information be provided to you in a structured and legible format to transmit them to a third party, if necessary

You can review and change your Personal Information by contacting us on our Help page to request access to, correct, or delete any Personal Information that you have provided to us. We cannot delete your Personal Information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect

Your California Privacy Rights

California Civil Code Section 1798.83 permits users of our Services that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please contact our Help page.

Rights of EU Residents 

If you are a resident of the European Union, you have certain rights pursuant to the European Union General Data Protection Regulation. These rights are described below. If you wish to exercise any of your rights, you may contact us through our Help page, and we will respond within a reasonable period of time.

  • Right to Access. You have the right to obtain information from us about the categories of Personal Information about you that we collect, maintain, and use. This Privacy Policy is our means of facilitating that right. In addition, our Service allows you to view the personal information that you have given us by accessing your account. 
  • Right to Rectification. You have the right to have us correct any inaccuracies about your personal data that we have in our records. You are able to do this through the online platform or service at any time by going into your account settings, or contacting us through our Help page.
  • Right to Erasure. In some limited circumstances, you have the right to obtain from us the erasure of your Personal Information. Where your Personal Information must be maintained by us for legal compliance purposes, we will not be able to delete the information. To request the deletion of your Personal Information, please contact us through our Help Page. 
  • Restriction on Processing. If you believe that the data we are processing about you is inaccurate or is otherwise obtained in an unlawful fashion, you have the right to request that we suspend the use of your Personal Information.
  • Portability. You are able to obtain a copy of any of your Personal Information that you provide to us by contacting us through our Help page.
  • Right to Withdraw Consent. Where the use of your Personal Information is based upon consent, you have the right to revoke that consent at any time. If you wish to revoke your consent, please contact us through our Help page.

International Transfer

If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your Personal Information to the United States and processing in the United States. By providing your Personal Information you consent to any transfer and processing in accordance with this Privacy Policy.

If you wish to withdraw your consent for the use of your Personal Information pursuant to this Privacy Policy, then you will need to terminate your account and cease all use of the Services. You can deactivate your account by contacting us through our Help page.
